Parent's Leave for School or Day Care Activities

Paid/Unpaid?

Employer Choice. Employer may allow use of vacation, personal leave or compensatory time off.

Applies to?

Parent or guardian of a child in K-12 or attending licensed day care facility.

Duration?

Up to 40 hours off per calendar year to participate in school or day care facility activities. Employee may be limited to no more than 8 hours off for this purpose in any one calendar month.

Guaranteed return to work?

Yes.

Guaranteed job assignment?

Same job.

Employer verification?

Employer may require documentation from school showing employee visited on specific date and particular time.

Penalties for failure to comply?

Labor Commissioner complaint and state court. Reinstatement and back pay.
